Pension Application for Tobias Cole

Decalaration: In order to obtain the benefit of the Act of Congress of the 7th July 1838 entitled “An act granting half pay & pensions top certain widows”.

County of Jefferson SS.
            On this 13th day of November 1845 personally appeared before the subscriber one of the Judges of the court in & for said county Sarah Cole of Watertown in said county aged eighty five years & upwards, who being first duly sworn according to law, doth on her oath make the following declaration , order to obtain the benefit of the provision made by the Act of Congress passed July 7, 1838 entitled “An act granting half pay & pensions to certain widows”.  That she is the widow of Tobias Cole late a soldier of the United States in the revolution, that her said husband resided in Orange County during the revolution & that he served under Capt. Andrew White, Col. Wiesenfels from eight months to one year in the year 1781 to 1782. That he also performed other service & under other officers, but of the particulars she cannot state.
            She further declares that she was married to the said Tobias Cole in the year Seventeen hundred eighty five that her husband the said Tobias Cole died in the year 1828 eighteen hundred and twenty eight; that she was not married to him prior to his leaving the service, but the marriage took place previous to the first of January seventeen hundred and ninety four, viz at the time above stated.  (Signed with her mark)  Sarah Cole

            I certify that the above named Sarah Cole is a respectable person, that she cannot from bodily infirmity attend the court.  S.C. Sherman Judge Jeff Co. Courts

            Personally appeared before the Subscriber a Justice of the Peace in & for said county, James Cole of Watertown in said County aged thirty four years & upwards, after being duly sworn according to law, deposes and says that Sarah Cole, who is by these presence making application for a pension, as the widow of Tobias Cole is this deponent’s mother & that the said Tobias Cole was this deponent’s father, that this deponent is thirty four years of age last December & that he has five brothers & four sisters older than himself, of the same father & mother, that his eldest brother is fifty eight years of age, that this deponent knows of no old family record of his said father & mother & their family, that his said father died in (1828) Eighteen hundred and twenty eight & that his said mother has remained a widow since that period & is still a widow.  (Signed) James Cole.

Note, the papers in the file show the dates of enlistment as 1781 or 1782, 8 mos. or 1 year.  Enlisted in Orange Co.  Residence at time of application Watertown, Jefferson Col., NY.  Sarah was 85 years old and had 6 sons and 4 daughters.  Claim was not allowed, lack of proof of service & date of marriage.
