Pension Application for James Humphry

On this ninth
day of November 1832, personally appeared before David McNeil, One of the Judges
of the Court of Common Pleas for said county, James Humphry, a resident of Phelps
in the county of Ontario and State of New York, aged seventy seven years, who
being duly sworn according to law, doth on his oath, make the following declaration
in order to obtain the benefit of the act of congress passed June 7th, 1832,
That he entered the service of the United States under the following named officers,
and served as herein stated. The entered the service about the first of
April 1776 an Orderly in Capt. William Tillford’s Company of New York Militia
in Col. James McClaughry’s Regiment. Resided at this time at New
Windsor then Ulster County now Orange County and State of New York. And
served in the said company one year, part of the time at Fort Montgomery on alarms
and a part of the time in the State of New Jersey. These services above
mentioned were during the year 1776 and 7—The other mentioned service in
the year 1777 a drafted militiaman in Capt. William Faulkner’s Company
of New York Militia in the Regiment commanded by Col. Cooper, resided in New
Windsor aforesaid—Served during the campaign Three Months, marched to the
Jersey lines in the vicinity of Paramus Church Hackensack & at the end of
this time of service, was verbally discharged and returned home—That in
the month of October in said year 1777 he again entered service inapt. William
Tillford’s Company in Col. James McClaughry’s Regiment from the place
aforesaid, marched to Fort Montgomery, was taken prisoner by the enemy the surrender
of Fort Montgomery on the day he entered service and remained a prisoner in the
hands of the enemy Ten Months, most of the time on board, the enemys prison ship,
near New York, during which time he suffered greatly through the severity of
the weather, short allowance &c—That in the year 1179 he again served
in Capt. David DeGarmos Company in Col. Peter Yates Regiment (at [?] different
periods) Two months—resided at the time at Tomhanick then Albany County
now the County of Rensselaer and State of New York—his duty was performed
at Fort George and Fort Edwards on the northern frontier principally again the
Indians. That he is well acquainted with James McDaniel, who was with him
during most of his services above described and will certify to the same and
that he is also well acquainted with Oliver Humphry and Charles Humphry who reside
in his neighbourhood and will certify to his character for veracity and their
belief of his having served in the Revolution—That he knows his age to
be seventy seven years from a record kept in this family Bible—That owing
to old age and bodily infirmity, he is not able to attend to court of Record
for the purpose of making his declaration—That he never received a written
discharge from his commanding officers at the time of the campaigns above described,
but always served faithfully until verbally discharged and that he has no documentary
evidence of service & relies wholey which proof herewith submitted.
He hereby
relinquishes every claim whatever to a pension or annuity except the present,
and declares that his name is not on the pension roll of the agency of any
State.

On
this 19th day of December 1833, personally appeared Oliver Humphry, a resident
of the County & of Onatario and State of New York, who being
first duly sworn according to law on his oath and despseth and says the James
Hunphry whose declaration is hereunto annexed is a brother of this deponent—That
he has known him from his youth—That during the revolutionary war,
they both resided in the Town of New Windsor (then Ulster now Orange County & State
of New York==That on the 1st day of April 1776, He recollects the said James,
entered the company formed by Capt. William Tillford in Col. James McClaughry’s
Regiment of New York Militia and that he said James was out during the whole
summer in said Company at Fort Montgomery. That during this summer
this deponent was not in the service with the said James but frequently saw
him at Fort Montgomery—He also knows that he was an Orderly Sergeant
in said Company during said Term—That this deponent knows the said
James, served three months at Ramapo in the State of New Jersey as he was
out with the said James during a part of this term of service and was a member
of the same Company and Regiment at the time viz. Capt. William Tellford—Their
services commenced during this term on the first day of November 1776. This
deponent further saith that he was called out on the sixth day of October
1777 to guard Fort Montgomery and that the said James Hunphry was also called
out at the time and were both at that time members of Capt. William Tellford’s
Company. That this deponent was that day with a detachment of men under
Capt. Cathback [Cuddeback] Guarding the chain across the
Hudson river and that the said James was also on that day at the Fort and
was taken prisoner and remained a prisoner in the hands of the enemy Ten
months—remember well the time
he with said James Humphry returned home after he was liberated—Thinks
he returned home in the month of August (of this year 1778)—This deponent
further saith that he knows the said James Humphry was an orderly sergeant
commissioned and served as such, while a number of Capt. William Tellford’s
Company—further this deponent saith not.
