Pension Application for Jeremiah Loucks

            On  this fourth day of June in the year of our Lord one thousand eight hundred and thirty three personally appeared in open court before the Honorable the court of common pleas of the county of Schohaire and State of New York now sitting Jeremiah Loucks a resident of the town of Middleburgh in the said County of Schoharie aged seventy years who being first duly sworn according to law, doth on his oath make the following declaration in order to obtain the benefit of the Act of Congress passed June 7th 1832.
            That he resided in that part of the State of New York now the Town of Middleburgh in the county of Schoharie from the commencement until the close of the Revolutionary War.  That he was enrolled as a private soldier in the Militia in the State of New York as early as the first day of May in the year 1779.  That the Regiment & company in which he was enrolled at the time of his enrollment was commanded by the following named officers, Colonel Peter Vrooman, Lieutenant Col. Peter Zelie; Majors Thomas Eckerson & Joseph Becker and Captain George Richtmyer.  That he does not recollect the names of the other officers.  That he belonged to the same Militia Regiment & company until the first day of May in the year 1783.  That the said Regiment & company were commanded by the above named officers during that time.  That from the said first day of May in the year 1779 until the first day of May in the year 1783 he was very frequently on duty in the service of the United States for short periods of from one day to one month at a time.  That he does not recollect the number of different times he was on duty.  That he was during most of those periods under the immediate command of the same officers of the Regiments or company to which he belonged but which officer had the command each time he cannot tell.  That he does not recollect the exact time he entered the service each or any of those periods nor the time when he left the same nor how long he was engaged on duty each time.  That he was not drafted, a volunteer or substitute any of the above periods to his knowledge.  That he was ordered into the service by some officer of his company or Regiment and entered the service in obedience to such order.  That he marched from the Middle Fort as near as he can recollect on the latter part the summer of the year 1781 to the Little Lake at the head of the Delaware River.  That he was in a battle at this place under Captains Hazen & Hale with the Tories & Indians.  That he was in the Middle Fort in Schoharie when Schoharie burnt in the year 1780.  That he was frequently engaged in the Middle & Upper Forts in Schoharie on garrison duty.  That he was several times on duty into those parts of the State of New York now the Counties of Green and Delaware.  That he cannot tell when he was engaged on duty each time.  That a small part of riflemen under Colonel Butler lay at Schoharie a short time after he commenced doing duty.  And the said Jeremiah Loucks saith that he is positive that he was engaged on duty in the service of the United States as a private soldier from the said first day of May in the year 1779 until the first day of May in the year 1783, at different periods in the whole amounting to at least two years.
            That he has no documentary evidence of his services above set forth.  That he never received a written discharge from the service.  That he has no record of his age.
            That he was born in the Town of West Camp in the County of Ulster in the State of New York where he resided eight years when he moved to that next of the State of New York now the town of Middleburgh in the County of Schoharie where he has since resided.
            He hereby relinquishes every claim whatever to a pension or annuity except the persons and declares that his name is not on the pension roll of the agency of any state.

            We John Garrison a Clergyman residing in the Town of Middleburgh in the County of Schoharie in the State of new York and Freeman Stanton residing in the said Town of Middleburgh hereby certify that we are well acquainted with Jeremiah Loucks who has sworn & subscribed to the above declaration that we believe him to be seventy years of age.  That he is respected and believed in the neighborhood where he resides to have been a Soldier of the Revolution in that we concur in that opinion.

            And the said court do hereby declare their opinion after the investigation of the matter and after ??? the interrogations prescribed by the War Department.  That the above named applicant was a Revolutionary Soldier and served  as he states.  And the court further certifies that it appears to them that John Garretson who has signed the preceding certificate is a clergyman.  [The record ends here.]

            On this twenty ninth day of October, 1839, personally appeared before the Judges of the Court of Oyer and Terminer, held in & for said county, Magdalene Loucks, a resident of the Town of Middleburgh in said county aged seventy three years, who being first duly sworn, according to law, doth on her oath make the following declaration in order to obtain the benefit of the provision made by the Act of Congress, passed July 7, 1839, entitled “An act granting half pay and pensions to certain widows”: That she is the widow of Jeremiah Loucks, who was a private soldier in the Revolutionary War at various periods in each year from the spring of 1779, to the fall of the year 1782; that he belonged to Capt. Richtmyer’s Company in Col. Vroomans Regiment.  That he entered the service each time at the (now) town of Middleburgh in the county of Schoharie, that the service chiefly consisted in Scouting, Keeping Garrison and going out on alarms in and about the adjoining towns and sometimes out of the county.  She thinks he was sometimes commanded by Capt. Richtmyer and sometimes by subalterns.  She is unable to specify the number of times he was called into the service, each year and she is also unable to state the duration of each tour of service and the names of the officers who commanded each time.  That her husband the aforesaid Jeremiah Loucks applied for a pension and died without obtaining it.
            She further declares that she was married to the said Jeremiah Loucks the 14th of September in the year seventeen hundred and eighty two, and that her husband died the aforesaid Jeremiah Loucks died on the 19th day of June 1834.  That she was not married to him prior to his leaving the service, that is to say, she has no distinct recollection of his having been called into the service after their marriage but the marriage took place previous to the first of January, seventeen hundred and ninety four viz at the time above stated.

            I George A. Lintner, pastor of St. Paul’s Lutheran Church of the town and county of Schoharie and state aforesaid do certify that on an examination of the register of marriages of said church.  I find therein recorded the marriage of Jeremiah Laux and Magdalena Bellinger in these words, “Anno. Seventeen hundred and eighty two den fourteen sep. Jeremiah Loux and Magdalene Bellinger” and further that the above extract is a true copy of the record with the exception of the date which is expanded on the record in four legible figured as follows, “Anno. 1782, deu? 14 Sep. Jeremias Laux and Madgalena Bellinger.”
            I George A. Lintner above named do despose and say that I am pastor of the church above named and that the foregoing is a true extract from the record of said church with the exception above mentioned as certified by me.  (Signed) G. A. Lintner
