Pension Application for John Overbagh

John Walker of the town of Broom County of Schoharie and State aforesaid being duly sworn deposeth and saith that he is seventy two years of age that in the revolutionary war deponent resided in the town of Catskill County of Greene that he was well acquainted with John or Johannis Overbagh of the same place who was a half brother of deponent and resided it the same family with deponent, that said John Overbagh was a Soldier of the revolutionary war for more than two years, that part of the time he was in the levies and part of the time in the Militia under different officers, that at one time he volunteered for 3 months and was stationed at the Middle Fort in the Village of Schoharie and at another time he was also engaged for three months and was stationed on the Hudson River towards New York or the State of New Jersey, and that at another time he volunteered in the levies for the term of 8 or 9 months and was stationed on the frontier of the County of Greene that as near as deponent can recollect the said John served also at several other times and places during said Revolution that deponent believes the said John served part of the above named service in Captain Philip Canine’s and part of the time in Captain Benjamin Dubois’ company --& in different officers on Col. Vanbergen Regt. And this deponent further saith that the said John Overbagh died several years since that he left a widow whose name Anna or Annatie who has ever since remained a widow and as deponent was informed is now an applicant for a pension. And this deponent further saith that he well recollects the time the said John Overbagh was married that deponent was not present but understood that the ceremony was performed by the Reverend John Schuneman and that it took place more than fifty two years since and further saith not. John Winne of the town of Cairo—County and state aforesaid being duly sworn deposeth and saith that he is seventy four years of age that he was a soldier in the revolutionary war, that he was well acquainted with John or Johannis Overbagh of the town of Catskill of said County, that the said John Overbagh was a soldier in a company of the levies of the State of New York, commanded by Captain Philip Canine—Lt Peter VanBergen, in the year 1781 as deponent now believes for the term of 8 or 9 months, that said company was stationed in the western part of said town of Catskill for the protection and defence of said County of Greene against the Indians and Tories.
That this deponent was also a soldier in the same company for the term of four months that deponent joined said company in the month of July or August of said year.—and continued until the close of said year of 1781 that said John Overbagh was in said company when deponent joined the same and continued as long as deponent, and always understood and verily believes that the said John Overbagh was in the said crops for the full term of 8 or 9 months and was discharged at the same time with deponent. And this deponent further saith that in the year 1779 deponent was a private soldier of the levies in a company commanded by Captain Benjamin Dubois and Lt Loup for 9 or 9 months and was stationed in the western part of the town of Catskill for the defence of the frontier of said County of Greene, that deponent has seen the said John Overbagh engaged as a soldier during the revolution several times but whether the said John was in Captain Duboises Company deponent cannot now recollect and further saith not. In reply to your report made the 17th of August 1840 in relation to the application of Mrs. Anna Overbagh widow of John or Johannis Overbagh or Overpagh under the act of July 7th 1838 for a pension.
I have the honor to say that I have no doubt that John Overbagh who according to the Comptrollers records served in three different places was the identical husband of the applicant—because in a conversation held with Solomon Schutt (who was a witness for Jeremiah Overbagh & is since dead—he informed me that he Schutt in a company commanded by Capt. Cantine, that Jeremiah & his brother John Overbagh in a company commanded by Capt. Benj’m Dubois were ordered down the Hudson River in the neighborhood of the highlands & almost immediately after ordered up the River to Albany & from thence to the Mohawk River where they remained under the command of Col. Malcom until the expiration of their term of service—except a part of Dubois’ company either volunteered or were transferred to a light Infantry company and remained in the Highlands and among those was John Overbagh—corresponding with the widows Statement in her declaration that he was present at the execution of Andrew.
The service in 1781 in Cantines Company is too well supported by the highest of evidence to admit of doubt. So also the services credited to him in the Militia under the command of the officers of the regiment in the place where he resided?
And from my own knowledge of the families of Overbaghs who were commonly called Overpaws—that no other John Overbagh existed at that period within the scope alluded to. I hope therefore you decision will favorable & whatever it may be you will please direct to the Hon Robert McClelland M.C.

Declaration. In order to obtain the benefits of the act of Congress of the 3rd March 1843 granting pensions for one year to certain widows who have received pensions under the act of July 7th 1838.

Greene County SS.
On this ninth day of December in the year of our Lord, one thousand eight hundred and forth three before me Ira Dubois a Justice of the Peace in and for the County of Green aforesaid personally appeared Anna Overbagh as resident of the town of Catskill County of Greene and State of New York aged eighty years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefits of the provision made by the act of Congress passed the 3rd March 1843, granting provisions to widows of persons who served during Revolutionary War.
That she is the widow of John Overbagh who was a private soldier and Sergeant in the Military Service of the State of New York in defence of his country during the revolutionary war, for which she was awarded a pension at the rate of forty eight dollars and fifty eight (cents) per annum under the act of Congress of the 7th July 1838 from the 20th day of March to the 20th day of March 1841.
She further declares that ever since the death of her husband she has not intermarried but remains the widow of the said John Overbagh as will more fully appear by reference to the proof hereto annexed.
She further declares that she has no documentary evidence nor any living witness to prove the services of her deceased husband for further proof of the foregoing statement she would respectfully refer to her former declaration and proof on file in the War Department under the act of congress of the 7th July 1838. Sworn to and subscribed on the day and year aforesaid before me, and further certify that I am personally acquainted with Anna Overbagh the said applicant above named. That she is the widow of John Overbagh deceased—she was a pensioner under the act of 7th July 1858 has not intermarried and is still the widow of the said John Overbagh, is a respectable citizen and her statement entitled to full credit.
