Pension Application for Cornelius House

1820 on this fourteenth day of June, personally appeared in Open Court in the Court of Common Pleas of the County of Montgomery being a court of records constituted and established by the constitution and laws of the State of New York in the said county who being first duly sworn according to law doth on his oath declare that he served in the Revolutionary Was as follows.

That he was enlisted to service during the war in a regiment of artillery commanded by Col. Lamb in the Line of the State of New York in Captain Doughtery’s Company sometime in the beginning of the year 1780 according to the best of the declarants knowledge said belief in which he served till regularly discharged in 1783 and that he has received a pension certificate under the seal of the War Office No. 1050 and I the said Cornelius House do solemnly swear that I was a resident citizen of the United States on the 18th March 1818 and that I have not since that time by gift, sale or in any manner disproved of my property or any part thereof with intent thereof. As to diminish it as to bring myself within the provision of an Act of Congress entitled “An Act to provide for certain persons engaged in the land and navel service of the United States in the Revolutionary War, passed on the 18th March 1818 and I have not nor has any person in trust for me any property or secured contractor debts due me, nor have I any income other than what is contained in the schedule hererto annexed and by me subscribed. Scheduled out 6 acres of land on which I reside in the Town of Johnstown on which is a small swelling house, one plough and one old wagon. One grindstone, some household furniture ,one scythe, one loom, one calf, two horses, one iron pot, one Bible.

Sworn to and declared on the 14th day of June 1820 in open court before me, John Carthy (Clerk)

And the declarant Cornelius House further saith that he has no mechanical trade but his occupation is that of a common labourer. That his is much afflicted with Rheumatism in his left shoulder, hip and knee and is not able to perform hard labour and is frequently in consequence of the Rheumatism in such a situation that he cannot labour at all. That his family residing with him consists of two daughters to wit, Jane House of the age of about thirty years and Nancy House of the age of about twenty seven years and a step daughter named Pother Wilkley aged about fifty eight years who has been confined to her bed for upwards of twenty years past in consequence of weakness or some inward complaint and is yet so confined without any probability of relief. That his daughters the said Jane and Nancy or one of them must always remain at the house to attend to his aforesaid step daughter. That one of them occasionally works out but this declarants get no part of their earnings. And the declarant further states that he is now justly indebted in the following sums of money for the six acres of land in the schedule of his property mentioned about. $70.00

Montgomery Common Pleas June four 1820.
It is the opinion of the court that the total amount in the value of the property exhibited in the schedule within contained is 154 dollars and 70 cents.

I, John McCarthy Clerk of the Court of Common Pleas in and for said County do hereby certify that the foregoing oath and the schedule thereunto annexed are truly copied from the record of the said court and I further certify that it is proved to the satisfaction of the said court by the oat of credible witnesses and that it is the opinion of the said court that the total amount in value of the property exhibited in the aforesaid schedule is one hundred fifty four dollars and seventy cents. In testimony whereof I have hereto set my hand and affixed the seal of the said Court on the 14th day of June 1820. John McCarthy

Montgomery County for: Cornelius House for the Town of Johnstown in the County of Montgomery and State of New York being duly sworn, deposeth and saith that he is listed as a Matross? Or private soldier in a company of Artillery commanded by Captain Doughty belonging to a Regiment of New York Artillery commanded by Col. Lamb sometime in the year one thousand seven hundred and eighty in the Revolutionary War between the United States and Great Britain. That he served in said Regiment from; the time of his enlistment as aforesaid until the Army of the United State was disbanded at the close of the war in the year one thousand seven hundred and eighty three, when he was honorably discharged. And this deponent further saith, that he is in reduced circumstances in life, and in need of assistance from his Country for support; and has never received any pension on account of his services.

Simon Veeder one of the Judges of the Court of Common Pleas for the County of Montgomery.

Personally appeared before me Simon Veeder one of the Judges of the Court of Common Pleas of the County of Montgomery aforesaid, the said Cornelius House in the written deposition named and made oath that he was enlisted as in the written deposition mentioned and mustered at New Windsor in the State of New York and that he was discharged from the Army at the close of the war as in the said deposition mentioned at West Point in the State aforesaid. That he was in the battle at Yorktown in Virginia under General Washington, at the taking of Lord Cornwallis. And this deponent farther saith that his discharge is not now in his possession, but that sometime after the close of the Revolutionary War, he delivered it to a man by the name of Michael Rawkins to draw some arrears of pay then due to this deponent and that the said Michael Rawkins (since deceased) never turned it to the deponent nor does he know where the same now is.

Simon Veeder, one of the Judges of the Court of Common Pleas for the County of Montgomery.

On the tenth day of June, in the year of our Lord, 1823, personally appeared in open court being the Court of common Pleas of said county in said state and being a court of record by the Constitution and laws of said state, Cornelius House, resident in said county aged sixty years on the first day of March last past who being first duly sworn, according to law, doth on his oath, make the following declaration in order to obtain the provision made by the act of Congress of the 18th of March 1813, and the first of May 1820. That he the said Cornelius House enlisted for the term of, for, and during the Revolutionary War on or about the month of November in the year of our Lord 1780 in the State afore said, in the company commanded by Captain Doughty, in the Regiment commanded by Colonel John Lamb in the Line of the State of New York (New York Line) aforesaid on the Continental establishment, that he continued in service in said corps until the month of June 1783 when he was discharged from said service at West Point in the State of New York.

That his name has been placed on the pension list and dropt there from on account of his property. And in pursuance of the act of May 1820. I do solemnly swear that I was a resident citizen of the United States, on the 18th day of March 1818 and that I have not since that time, by gift, sale or in any manner disposed of my property or any part thereof with intent thereby so to diminish it as to bring myself within the provisions of an act of Congress entitled an act of provide for certain persons engaged in the land and naval service of the United State in the Revolutionary War passed on the 18th day of March 1818, and that I have not, nor has any person in and for me, any property or any securities, contracts, or other debts due to me, nor have I any income other than what is contained in the schedule hereto annexed, and by me subscribed to wit, six acres of land, on which I reside in Johnstown, Montgomery County, New York State, on which is a small dwelling house, one plough, some old iron of a wagon, one grind stone, a few articles of old and nearly worn out household furniture, one scyth, one loom, one calf, two horses, one iron pot, one Bible.

That since the exhibition of my last schedule the following changes have been made in my property, that the land stated in my said first inventory, I held by article of assignment from John Davis, by which it was stipulated I should pay two hundred and fifty dollars and then receive a conveyance for it, that I was unable to pay the money within the time stipulated, the said John Davis declared the contract forfeited and all my rights at an end, and he then sold, conveyed it to Nicholas Yordon and I occupy it as a tenant at which under an obligation to pay of the seasonable use and occupation of it. That at the other articles dated except the furniture I have sold for the purpose of supporting myself and family and I just own one old mare.

That I am by occupation a farmer, but I am unable to do scarcely any labor at that, in consequence of old age and severe rheumatic complaint under which I labor daily and cannot fully open one of my hands by reason of it. That have one daughter residing with me, named Nancy aged thirty years and she is able to support herself by her labor, that I am unable to support myself by labor.

Montgomery County SS, I Henry J. Yates, Clerk of the Court of Common Pleas of the said county, do hereby certify, that it appears to satisfaction of the court that the said Cornelius House did serve in the Revolutionary War, as stated in the preceding declaration against the common enemy for the term of nine months under one engagement, on to Continental establishment. I also certify that the foregoing oath, and the schedule there to annexed, are truly copied from the records of said court, and I do further certify, that it is the opinion of the said court, that the total amount of value of the property exhibited in the aforesaid schedule is fifteen dollars. In testimony hereof, I have hereunto set my hand and affixed the seal of the said court on this the 10th day of June 1829.
